conditions de ventes
Le commissaire-priseur agit comme mandataire du vendeur.
En aucune manière le commissaire-priseur n’est partie au contrat qui unit le vendeur à l’acheteur.
Il est entendu que sous la dénomination « Étude LASSeRON » sont regroupées les entités « SVV Lasseron & Associés » et « Maître Olivier Lasseron, commissaire-priseur judiciaire ». Cette présente dénomination s’applique à l’ensemble des conditions de ventes.
1 – LES BIENS MIS EN VENTE
Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresser avant la vente aux enchères et notamment pendant les expositions. Les lots judiciaires sont vendus en l’état, sans aucunes garanties. Les garanties énumérées dans le présent paragraphe portent uniquement sur les lots volontaires.
La description des lots figurant sur le catalogue, les rapports d’état ou les étiquettes ainsi que les indications énoncées verbalement ne sont que l’expression par l’Étude LASSeRON ou son expert de leur perception du lot. Elles ne sauraient constituer la preuve d’un fait.
Les indications données par l’Étude LASSeRON ou son expert sur l’existence d’une restauration, d’un accident ou d’un incident affectant le lot, sont exprimées pour faciliter son examen par l’acquéreur potentiel et restent soumises à son appréciation personnelle ou à celle de son expert.
L’absence d’indication d’une restauration, d’un accident ou d’un incident dans le catalogue, les rapports d’état, les étiquettes ou verbalement, n’implique nullement qu’un bien soit exempt de tout défaut.
Inversement la mention de quelque défaut n’implique pas l’absence de tout autres défauts. Les estimations sont fournies à titre purement indicatif et elles ne peuvent être considérées comme un prix certain. Les estimations ne sauraient constituer une quelconque garantie.
Les dimensions sont données à titre purement indicatif. Les photos reproduites dans le catalogue n’ont aucune valeur contractuelle.
Concernant les tableaux, l’état des cadres n’est pas garanti. Les restaurations d’usages et rentoilages sont considérés comme des mesures conservatoires n’entraînant pas de dépréciation et ne constituant pas un vice.
Concernant l’horlogerie, notamment les montres et les pendules, aucunes garanties sur les mécanismes et leurs fonctionnements ne seront données à l’acheteur.
Concernant les bijoux et métaux précieux, la législation en vigueur et notamment le décret 2002-65 du 14 janvier 2002 et la loi 2004-1485 du 30 décembre 2004 s’appliquent. Les lots précédés de la mention Dc sont à charge du contrôle en vigueur en France sur les objets en métaux précieux. Ces derniers peuvent donc ne pas être disponibles immédiatement à l’issue de la vente. Les frais de contrôle éventuels sont à la charge de l’adjudicataire.
2- LA VENTE
La vente est faite au comptant et sera conduite en euros. Le règlement des objets ainsi que celui des taxes s’y appliquant seront effectués dans la même monnaie. L’adjudicataire sera le plus offrant et dernier enchérisseur.
En vue d’une bonne organisation des ventes, les acquéreurs potentiels sont invités à se faire connaître auprès de l’Étude LASSERON avant la vente afin de permettre l’enregistrement de leurs données personnelles. L’Étude LASSERON se réserve le droit de demander à tout acquéreur potentiel de justifier de son identité ainsi que de ses références bancaires.
Toute personne qui se porte enchérisseur s’engage à régler personnellement et immédiatement le prix d’adjudication augmenté des frais à charge de l’acquéreur et de tous impôts ou taxes qui pourraient être exigibles.
Tout enchérisseur est censé agir pour son compte sauf dénonciation préalable de sa qualité de mandataire pour le compte d’un tiers, acceptée par l’Étude LASSERON.
L’Étude LASSERON dirige la vente selon les usages établis. En cas de contestations le commissaire-priseur dirigeant la vente pourra décider de désigner l’adjudicataire, d’annuler la vente, de la poursuivre ou de remettre le lot en vente. En cas d’enchères simultanées au moment du prononcé « adjugé » ou de tout autre signe signalant la fin de la vente du bien, le commissaire-priseur pourra remettre immédiatement le lot en vente au prix de l’avant-dernière enchère. Le lot sera alors adjugé au plus offrant et dernier enchérisseur.
3- ORDRE D’ACHAT
L’Étude LASSERON accepte gracieusement d’enchérir pour le compte d’acheteurs potentiels préalablement identifiés par un ordre d’achat dûment rempli, daté et signé avec remise d’un chèque, d’un RIB, d’espèces, ou d’un numéro de carte bancaire en cours de validité, au plus tard la veille de la vente. En l’absence de ces conditions l’Étude LASSERON se réserve le droit de refuser de porter les enchères pour le compte des personnes ne remplissant pas les conditions ci-dessus énumérées. Les acquéreurs ne pouvant assister à la vente acceptent l’ensemble des présentes conditions sans restrictions.
Si plusieurs ordres d’achat identiques sont remis à l’Étude LASSERON, l’ordre le plus ancien sera préféré à tous les autres. L’Étude LASSERON se réserve le droit de prendre l’ordre d’achat en fonction de son montant et au regard de l’estimation de l’objet annoncé.
L’Étude LASSERON ne pourra voir sa responsabilité engagée notamment en cas d’erreur, d’incident technique ou d’omission dans l’exécution d’ordre écrit ou téléphonique.
Les lots de mobilier et objets encombrants ne seront jamais ramenés à l’étude.
Pour les autres lots, au-delà de 3 semaines après l’adjudication, si les lots ne sont pas réglés et récupérés, la maison de vente facturera le stockage au tarif de 2€ par jour et par objet.
4.1- FRAIS ET TAXES
En sus du prix d’adjudication, l’acquéreur devra s’acquitter des honoraires suivants par lots et par tranches, pour les lots volontaires (hors lots suivis d’un astérix vendus avec des frais judiciaires de 14,4 % TTC) :
- de 1 à 150 000 € : 24 % HT (28 % TTC,)
- de 150 001 € à 600.000 € : 20 % HT (24 % TTC)
- au delà de 600.001 € : 12 % HT)
4.2 - PAIEMENT
Pour les adjudicataires résidant en France : les particuliers pourront payer en espèce à hauteur de 1 000 euros frais compris ; les professionnels, à hauteur de 1 000 euros frais compris.
En cas de vente par un vendeur assujetti à la marge, il ne sera délivré aucun document faisant ressortir la T.V.A.
En cas de paiement par chèque par l’adjudicataire, le transfert de propriété de l’objet n’aura lieu qu’après encaissement du chèque. En cas de paiement par chèque non certifié, le retrait des objets pourra être différé jusqu’à encaissement.
Les clients non-résidents en France ne pourront prendre livraison de leurs achats qu’après un règlement bancaire par télex, SWIFT ou eurochèque. Tous frais financiers occasionnés par un de ces moyens de paiement ou par un incident bancaire seront à la charge exclusive de l’acquéreur. Dans le cas d’une défaillance de paiement de la part de l’adjudicataire et après une mise en demeure infructueuse, l’Étude LASSERON pourra à la demande du vendeur remettre le bien en vente sur folle enchère immédiatement ou dans un délai de trois mois.
Dans le cas où le vendeur ne formule pas cette demande la vente sera résolue de plein droit sans préjudice de dommages et intérêts dus par l’adjudicataire défaillant.
L’Étude LASSERON se réserve la possibilité de procéder à toute compensation avec des sommes dues à l’adjudicataire défaillant.
5- STOCKAGE
L’Étude LASSERON n’est pas responsable des accidents ou détériorations intervenus après le prononcé du mot adjugé. Les lots sont sous l’entière responsabilité des adjudicataires.
Les acheteurs qui n’auront pas retiré leurs biens le lendemain de la vente avant 10 heures devront s’acquitter auprès de la société de gardiennage des frais de stockage ainsi que des frais d’assurance ou de tout autre frais engagé par l’Étude LASSERON pour le compte de l’acheteur.
Pour les ordres d’achat, au-delà de 3 semaines après l’adjudication, si les lots ne sont pas réglés et récupérés, la maison de vente facturera le stockage au tarif de 2€ par jour et par objet.
6- TRANSPORT
L’Étude LASSERON ne dispose pas de service d’expédition spécifique.
Nous invitons les acheteurs qui souhaitent que leurs biens soient livrés par tous moyens postaux ou par transporteurs à se rapprocher du service de DROuOT TRANSPORT afin d’obtenir un devis. Ils s’acquitteront avant tout expédition du montant total des frais.

7- CONTESTATION
Les parties conviennent que tout litige ou contestation fera en premier lieu l’objet d’une tentative de conciliation. En cas d’échec de la conciliation, le litige sera de la compétence exclusive des Tribunaux de Paris.

The Auction House SVV LASSERON & ASSOCIES is a voluntary sales company governed by the law of 20 July 2011. The Auction House acts as agent for the seller who enters into a sale contract with the purchaser.
The auction sales organised by the Auction House SVV LASSERON & ASSOCIES are hereby subject to the following conditions of sale:
Goods put up for sale
Potential purchasers are invited to examine the goods that might be of interest to them during the exhibitions which are organised by the Auction House SVV LASSERON & ASSOCIES before the auctions.
Condition reports may be requested from the Auction House by letter, telephone or electronic mail. They will be sent free of charge but are to be used for information only. The reports will include the artistic and scientific information known to the Auction House at the date of the sale and the latter will not accept any responsibility for errors or omissions. The descriptions to be found in the catalogue are drawn up by the Auction House and where applicable by the expert who assists the former, subject to notices and corrections given when the lot is presented and included in the bill of sale. Sizes, weights and estimates are given for information purposes only.
The coIours of the works included in the catalogue may vary due to printing techniques.
The lack of information on the condition of the goods in the catalogue will by no means imply that the lot is in a perfect state of preservation or free from restoration, wear, cracks, relining or other imperfection.
The goods are sold in the state they are found at the time of sale.
As the prior exhibition has enabled potential purchasers to examine the object, no claim will be accepted once the hammer has gone down.
Auction sales
The auction sales are carried out in the order of the catalogue numbers. The bidders are invited to make themselves known to the Auction House SVV LASSERON & ASSOCIES before the sale to ensure that their personal details are recorded beforehand.
Bidders are generally present in the room.
However, any bidder who would like to place an absentee bid in writing or bid by telephone may use the form, intended for this purpose, to be found at the end of the sale catalogue or on the website www.lasseron-associes.com.
The form should be sent to the Auction House SVV LASSERON & ASSOCIES together with a bank identification slip [RIB in France] or bank details at least before Sunday 5th November 2016 at 8.00 P.M
The Auction House SVV LASSERON & ASSOCIES will deal with auction sales by telephone and absentee bids free of charge. In all cases, the Auction House cannot be held responsible for a problem with the telephone link along with an error or omission in the execution of the absentee bids received.
ln the event of two identical absentee bids, preference will be given to the earliest absentee bid. The bidder who is present in the room shall have priority over an absentee bid should the two bids be of equivalent amounts. The successful bidder will be deemed to be the individual who has made the highest bid. In the event of a double bid which is confirmed as such by the auctioneer, the lot will be put up for sale again and any or all persons present will have the right to take part in the second sale by auction
BUYER’S PREMIUM
ln addition to the hammer price, purchasers will be required to pay the folIowingcosts and taxes per lot and per block:
- from 1 to 150 000 € : 24 % before tax
(28,80 % inclusive of tax, except lots with ‘‘*’’)
- from 150 001 € to 600.000 € : 20% before tax (24 % inclusive of tax, except lots with ‘‘*’’)
- above 600.001 € : 12% before tax
(14,40 % inclusive of tax, except lots with ‘‘*’’)
Payment
Payment must be paid immediately after the sale in euros. In the event that the successful bidder has not given their personal information before the sale, they will be required to provide proof of identity and bank details.
The successful bidder may pay using one of the following methods:
- in cash within the limits of the legislation in force.
- by bank transfer.
- by cheque, with the presentation of
identity papers being compulsory.
Cheques drawn on a foreign bank will only be accepted provided prior consent
is obtained from the Auction House
SVV LASSERON & ASSOCIES. Purchasers are advised to provide a letter of credit from their bank for an amount which is close to their intended purchase figure.

Failure to pay
ln the event of failure to pay the hammer price and fees, formal notice will be sent to the purchaser by registered letter with acknowledgement of receipt. ln the event of failure to pay at the end of the deadline of one month after the sending of the formal notice, the purchaser will be required to pay an additional fee of 10 % of the hammer price, with a minimum of 250 euros, to cover collection costs.
This clause being applied will not hinder the awarding of damages and costs for the legal proceedings which will be required, and does not exclude the article being put up for sale again in a new auction which is governed by article L 321 -14 of the Commercial Code.
Within the framework of this new auction, the Auction House hereby has the right to claim the payment of the difference between the initial hammer price and the subsequent hammer price obtained from this reiteration of auction, if this last is lower, together with the costs incurred due to the second Auction sale from the defaulting successful bidder.
The Auction House SVV LASSERON & ASSOCIES hereby reserves the right to offset against the amounts owed to the defaulting successful bidder. Furthermore, the Auction
House SVV LASSERON & ASSOCIES hereby reserves the right to exclude any or all successful bidder who has not complied with these conditions of sale from its future auction sales.
The Auction House SVV LASSERON & ASSOCIES is member of the Central Registry for auctioneers for the prevention of outstanding invoices of the auctioneers where a default in payment can be inscribed.
The debtor can access, modify or make an opposition for a legitimate reason before the SYMEV at the following address: 15 rue Freycinet 75016 Paris.
Collection of purchases
No lot will be handed over to the purchasers before all of the amounts owed are settled.
ln the event of payment with a non-certified cheque or by bank transfer, delivery of the articles may be differed until receipt of the amounts owed. As soon as the auction sale is concluded, the articles will be placed under the purchaser’s full responsibility. With regard to the collection of lots which have not been taken on the date of the sale, you are advised to contact the Auction House SVV LASSERON & ASSOCIES prior to collection on +33 (0)1 49 95 06 84
An appointment can be made to collect small paintings and objects of art at 46 rue de la Victoire 75009 Paris, from Monday to Friday from 9.00 a.m. to 1.00 p.m. and from 2.00 p.m. to 6.00 p.m.
Furniture and in general terms any bulky articles are stored at DROUOT MAGANISAGE, 3 rue Rossini 75009 (Monday to Saturday 9.00 a.m to 10.00 a.m and 13.00 p.m to 18.00 p.m). Storage costs are to be paid by the purchaser and will be invoiced directly by our partners to the purchaser with the tariffs in force.

Export
Tax refund
The VAT will be refunded to the buyers who are non-European Union residents upon presentation to our accountant of the export declaration (SAD) of the good(s) purchased duly endorsed by the competent customs authority, within 3 months after the sale. The export declaration must mention the auction house SVV LASSERON & ASSOCIES as the consignor and the buyer as the consignee of the good(s).
The export of the works of art considered as “cultural goods” must be authorized by the Ministry for the Arts (see article L 111-2 of the Patrimony Code).
The export to a country within the European Union requires a certificate of export issued by the Ministry of the Arts with a delay up to 4 months. This certificate could be asked by the Auction House on behalf of the buyer after the sale.
The export to a country outside the European Union requires a certificate of export as well as an export licence and a customs declaration.
In this case, the buyer has to pass through a transit company in order to ask for these export authorizations.
The Ministry of the Arts issues or refuses the certificate of export within a maximum delay of 4 months and the licence export need two further weeks to be obtained.
The documents required must be presented to the customs officers.
The law punishes to penalties the person who exports or tries to export a cultural good without the authorizations required (see article L 114-1 of the Patrimony Code).
The works of art are considered as cultural goods according to their age (generally from 50 years) and their value (price with taxes included) which varies by categories (€ 150 000 or more for paintings, € 15 000 or more for prints…).
These thresholds are set by the decree
n° 93-124 of the 29th January 1993 and by the European Regulation of the 18th December 2008 (n° 116/2009).
The Auction House is not responsible for the delay or the refusal of the export certificate from the Ministry for the Arts.
Governing law and jurisdiction
These conditions of sale are governed by French law. Any or all dispute relating to the wording, validity and performance will be settled by the court or competent jurisdiction in Paris.
